Terms of Service

1. Who we are

ExpediteMySite is a website design service based in Cypress, TX 77429, operated by Dion Williams.

2. What you're buying

• Website builds — a one-time website design and launch engagement at a fixed price. Tiers: Launchpad, Growth, Pro, and Enterprise (sales-led).
• Add-ons — optional one-time additions to a build (rush delivery, extra page, copywriting, logo, advanced SEO).
• Subscriptions — recurring maintenance and growth plans (Site Shield, Growth Engine, AI Business Suite). Billed monthly or annually. Cancel any time.

The exact deliverables for each tier are listed on /pricing. That list is incorporated into these Terms by reference.

3. Payments

All prices are in U.S. dollars. Payments are processed by Stripe. You can choose pay in full or a 50% deposit; the remaining 50% is invoiced at delivery for deposit orders.

Subscriptions renew automatically on the same date each month or year. Price changes apply to your next renewal and we'll email you at least 30 days in advance.

You authorize us (via Stripe) to charge the payment method you provide. If a renewal payment fails, we retry per Stripe's Smart Retries schedule and notify you. After three failed retries we may suspend the subscription.

4. 48-hour delivery guarantee

For Launchpad and Growth builds, we deliver a working preview within 48 hours of receiving your complete intake (business info, logo or brand direction, any required content, and paid deposit or full payment). If we miss the 48-hour window through our own fault, you pay nothing — see the Refund Policy for how that works and what counts as “our fault”.

5. Your responsibilities

• Complete the intake accurately and on time. You confirm that any content, images, or logos you provide are yours or you have the right to use them.
• Respond to our questions within the time shown in the build timeline. We pause the 48-hour clock while we wait on you, and resume it when you reply.
• Provide us with any credentials we need to launch (domain registrar, Google Business, social accounts). You can revoke access after launch.
• Use the site lawfully — no illegal content, fraud, spam, or activity that violates third-party rights.

6. Ownership & license

Once the final invoice is paid, you own the content and design of the delivered website, including copy we write for you and logos we design for you.

We retain ownership of the underlying templates, code libraries, prompts, and internal tools we use to produce the site. We also retain the right to display the finished site in our portfolio unless you ask us in writing not to.

Third-party components (fonts, stock photos, plugins, hosting, payment processing) remain subject to their respective licenses.

7. AI-generated content

We use OpenAI's GPT models to draft initial homepage copy, offer language, and brand direction. You review the output before anything goes live. You are responsible for verifying that final copy is accurate to your business. We don't guarantee that AI output is free of errors, and we recommend reviewing claims about pricing, licensing, or compliance before publishing.

See the Refund Policy for full details. In short: builds are refundable before work begins and under the 48-hour guarantee; subscriptions cancel at the end of the current billing period and are not prorated.

9. Warranty disclaimer

The Services are provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Services will be uninterrupted, error-free, or secure. We do not guarantee any specific business outcome, revenue figure, or search-engine ranking.

10. Limitation of liability

To the maximum extent permitted by law, ExpediteMySite's total liability arising out of or relating to these Terms or the Services is limited to the total amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost data, even if advised of the possibility.

Some jurisdictions don't allow these limitations; in that case they apply to the maximum extent permitted.

11. Indemnification

You agree to indemnify and hold ExpediteMySite harmless against any claim arising from content you provide (copy, images, logos), your use of the delivered site, or your breach of these Terms.

12. Termination

Either party may terminate with written notice. Subscriptions terminate at the end of the paid period. If we terminate for your material breach (non-payment, illegal use, abuse of our team), we keep the portion of fees earned to that point.

13. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Exclusive jurisdiction and venue lies with the state and federal courts located in Harris County, Texas. You and ExpediteMySite each waive the right to a jury trial. Disputes under $10,000 may be brought in small-claims court. This section doesn't prevent either party from seeking equitable relief to protect intellectual-property rights.

14. Changes to these Terms

We may update these Terms. Material changes will be emailed to active customers at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.

15. Miscellaneous

These Terms (plus the Privacy Policy, Refund Policy, and your order confirmation) are the entire agreement. If any provision is unenforceable, the rest stay in effect. No waiver is implied by delay. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
